CHS Social Media Policy for the General Public
This Policy is for those who wish to interact with CHS or any of its entities through social media. We encourage your posts and comments in social media channels maintained by CHS or any of its entities. Please understand that CHS or any of its entities does not offer medical advice, diagnosis or treatment via the Internet. If you have a question about a specific medical condition, you should contact your doctor or other qualified health care professional.
If you are a CHS employee, you must adhere to the CHS Social Media Policy for Staff found on the CHS intranet.
Safeguard Your Privacy
You expressly acknowledge that you assume all responsibility related to the security, privacy and confidentiality risks inherent in sending any content over the Internet. By their very nature, a website and the Internet cannot be absolutely protected against intentional or malicious intrusion attempts. CHS or any of its entities does not control the third party sites and the Internet over which you may choose to send confidential personal or health information or other content, and, therefore, CHS or any of its entities does not warrant any safeguard against any such interceptions or compromises to your information when posting any content on an Internet site. You should think carefully about your own or others’ privacy in disclosing detailed or private information about yourself or others. Please remember that your posts and comments are available for all to see.
You are prohibited from posting any content that is personal health information, including patient images, on any Social Media Site. You are prohibited from using the Social Media Sites to provide medical advice or medical commentary by non-CHS physicians or to use the Social Media Sites to make, recommend or increase referrals to physicians who are not employed by CHS.
CHS or any of its entities does not necessarily endorse any product, service, views or content displayed on these Social Media Sites. You may not provide any content to these Social Media Sites that contains any product or service endorsements or any content that may be construed as political lobbying, solicitations or contributions or use these Social Media Sites to link to any sites or political candidates or parties or use these Social Media Sites to discuss political campaigns, issues or for taking a position on any legislation or law.
You agree that you will not: violate any local, state, federal or international laws and regulations, including but not limited to copyright and intellectual property rights laws regarding any content that you send or receive via this Policy; transmit any material (by uploading, posting, e-mail or otherwise) that is unlawful, disruptive, threatening, profane, abusive, harassing, embarrassing, tortuous, defamatory, obscene or libelous, or is an invasion of another’s privacy, is hateful or racially, ethnically or otherwise objectionable, as solely determined at CHS’s or any of its entities’ discretion; impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity; transmit any material (by uploading, posting, e-mail or otherwise) that you do not have a right to make available under any law or under contractual or fiduciary relationships; transmit any material (by uploading, posting, e-mail or otherwise) that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party; transmit (by uploading, posting, e-mail or otherwise) any unsolicited or unauthorized advertising (including advertising of services or products not belonging to CHS or any of its entities), promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes” or any other form of solicitation; transmit any material (by uploading, posting, e-mail or otherwise) that contains software viruses, worms, disabling code or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; harass another; or collect or store, or attempt to collect or store, personal data about third parties without their knowledge or consent; or to share confidential pricing information of any party.
CHS Reservation of Rights
CHS or any of its entities reserves the right to monitor, prohibit, restrict, block, suspend, terminate, delete or discontinue your access to any of these Social Media Site pages, at any time, without notice and for any reason and in its sole discretion. CHS or any of its entities may remove, delete, block, filter or restrict by any other means any materials at CHS’s or any of its entities’ sole discretion. You understand and agree that CHS or any of its entities may disclose your communications and activities with respect to CHS or any of its entities in response to lawful requests by governmental authorities, including Patriot Act requests, judicial orders, warrants or subpoenas, or for the protection of CHS’s or any of its entities’ rights. You agree that in the event that CHS or any of its entities exercises any of its rights hereunder for any reason, CHS or any of its entities will have no liability to you.
CHS or any of its entities does not moderate or censor comments, but we reserve the right to delete comments that are abusive or off-topic or that contain foul language, spam or advertisements for commercial products. Disagreements and feedback/criticism are welcome, but mutual respect is a must, and abusive language is out of bounds. Obscenities, personal attacks and defamatory comments about any person, group, organization or belief will be removed. Please confirm your facts before you post. We may correct or remove factual errors.
CHS or any of its entities may suspend, change or discontinue any social media aspect of CHS or any of its entities. By posting any content on any of these Social Media Site pages, you grant to CHS or any of its entities the irrevocable right to reproduce, distribute, publish and display such content and the right to create derivative works from your content, edit or modify such content, and use such content for any CHS or any of its entities’ purpose.
Choice of Law and Indemnification
You agree that any claim or dispute relating to your posting of any content on a Social Media Site on the Internet shall be construed in accordance with the laws of the State of New York without regard to its conflict of laws or provisions, and you agree to be bound and shall be subject to the exclusive jurisdiction of the local, state or federal courts located in New York State.
You shall defend, indemnify and hold CHS or any of its entities and its corporate affiliates and their respective officers, directors, trustees, employees, contractors, agents, successors and assigns harmless from and against, and shall promptly reimburse them for: any and all losses, claims, damages, settlements, costs and liabilities of any nature whatsoever (including reasonable attorneys’ fees) to which any of them may become subject arising out of, based upon, as a result of or in any way connected with your posting of any content to CHS or any of its entities’ Social Media Sites, any third party claims of infringement or any breach of this Policy.
Neither CHS or any of its entities nor its content or service providers guarantee or warrant CHS’s or any of its entities’ Social Media Sites against errors, defects, delays, omissions, interruptions or losses, including losses of data, nor are any files downloaded from CHS’s or any of its entities’ sites warranted or guaranteed to be free of viruses, bugs, worms or other such destructive elements.
As new forms of social media emerge, we will periodically update this Policy. To remain in compliance, CHS or any of its entities suggests that you review the Policy, as well as the other website policies, at regular intervals. By continuing to post any content after such new terms are posted, you accept and agree to any and all such modifications to this Policy.
If you do not agree to this Policy, you may not use CHS’s or any of its entities’ Social Media Sites.
THIS POLICY MAY BE UPDATED AT ANY TIME WITHOUT NOTICE, AND EACH TIME A USER ACCESSES A SOCIAL MEDIA SITE, THE NEW POLICY WILL GOVERN USAGE, EFFECTIVE UPON POSTING.
